a) it is a non-photographic work and 50 years have passed since the end of the calendar year in which the author died;
b) it is a photograph and 50 years have passed since the end of the calendar year in which it was first published.

Additionally, by virtue of the Act's Transitional Provisions, Part I, Sec. 2, all photographs that were taken before January 1st, 1967 enter the public domain 50 years after production regardless of their publication date.

• it was simultaneously published (within 30 days) in the U.S. and in its source country (Zimbabwe) and is in the public domain in the U.S. as a U.S. work (no copyright registered, or not renewed),

or

• it was first published outside the United States (and not published in the U.S. within 30 days) and
• it was first published before 1978 without complying with U.S. copyright formalities or after 1978 without copyright notice and
• it was in the public domain in its home country (Zimbabwe) on the URAA date (Jan 1st, 1996).

This work may still be copyrighted in other countries.
